New Personal Injury Protection Laws That Will Affect You

New Time Limits in Seeking Treatment

Unlike the old law, which provided no particular time limit to seek treatment following an automobile accident where your PIP benefits apply, the new law gives you only 14 days to seek treatment following the date of the accident. If you do not see a doctor during that time frame, you will lose the ability to use your PIP coverage for any necessary treatment. This makes it critical to consult with our office promptly if you believe you have been injured in any way. 

Changes in Coverage and Treatment Options

While you will continue to be required to carry and pay insurance premiums for a full $10,000 of PIP coverage, you will only be entitle to $2,500 reduced benefit except in certain situations. The new law requires you have a determination of an "emergency medical condition" to access your full $10,000 benefit. It also restricts who is allowed to make that determination, unfairly discriminating against chiropractic physicians. The new law also no longer covers massage therapy or acupuncture treatment.
